Personal Data Policy

Preamble

In the context of browsing the bienvenueaucanada.ca website (hereinafter referred to as the "Site"), Zest Publishing may collect and process personal data about any user of the Site (hereinafter referred to as the "User(s)").

Any information relating to a physical person likely to be identified directly or indirectly (for example, surname, first name, ID, e-mail address, location data, etc.) is considered personal data (hereinafter "Personal Data" or "Data").

This Personal Data Policy (hereinafter the "Policy") specifies the processing methods for which Zest Publishing is responsible, in accordance with the regulations in force. The purpose of the Policy is to inform Users of the practices for collecting, using, storing and sharing Personal Data.

Zest Publishing reserves the right to modify, at any time and without notice, all or part of the rules relating to the protection of Personal Data. These modifications come into effect and are enforceable against Users as soon as they are posted on the Site.

ARTICLE 1 - Responsibility for processing personal data

ARTICLE 2 - Collection and use of data

2.1. COLLECTION OF PERSONAL DATA

By spontaneously communicating his Personal Data, the User expressly consents to the collection and processing of his Data for the purposes mentioned in article 2.1.2 below.

Users are informed that the content of the Site is intended for those over sixteen (16) years of age. Users under the age of sixteen (16) are therefore not entitled to register on the Site (account, newsletter, contests, etc.).

2.1.1 Personal Data likely to be collected

Certain Personal Data of the User are likely to be collected when the User :

- registers on the Site, whatever the purpose (for example, creating an account by email address or via social networks, registering for a newsletter or competitions offered on the Site);

- sends a request via the contact form of the Site;

- sends a manuscript via the portal of the Site;

- uses plug-ins or buttons in connection with social media ; 

Such Data may include:

- the User's identification and contact data (last name, first name, postal address, email address, telephone number);

- demographic information about the User (gender, date of birth or age, information about his or her interests...);

- the User's account login data (user ID, password);

- the User's browsing data (IP address, browsing history, type of browser, pages viewed, if applicable, cookies...).

The Data marked with an asterisk are mandatory. Failure to provide any of this information will not allow us to send the User the information requested, to process his/her request or to give him/her access to said service.

2.1.2 Purpose of processing personal data

Zest Publishing collects the User's Personal Data in order to :

- allow the User to participate in a contest and manage his/her participation;

- communicate with the User, in particular to:

a) send newsletters if he/she has consented,

b) process his/her requests via the contact forms;

- allow access to content external to the Site, including sharing on social networks;

- to carry out statistical studies and needs analysis;

- to meet legal and regulatory obligations.
 

2.2. DATA COLLECTION VIA COOKIES

Zest Publishing may use tools or softwares to analyze and collect general, aggregate or demographic information, which may be provided in the context of surveys, studies (purchasing habits, etc.) or anonymous aggregate data concerning the use of the Site, the type of Internet browser, the User's operating system, the IP address, the duration of the connection or the pages visited.

This data is collected for statistical and security purposes and is used to improve the quality of the services offered. 

ARTICLE 3 - Recipients of personal data

The Personal Data collected by Zest Publishing is intended to be used by Zest Publishing. 

However, Personal Data may be transmitted to third-party technical service providers and/or to third parties whose content is accessed from the Site, solely for the purposes of providing and ensuring the proper functioning of the services offered on the Site.

Users' Data may nevertheless be communicated to any judicial or administrative authorities that may request it.

ARTICLE 4 - Duration of storage of personal data

Zest Publishing keeps Personal Data for a period that does not exceed the time required for the purposes described in Article 2.1.2.

Personal Data intended to allow access to content external to the Site, including sharing on social networks, are not kept.

ARTICLE 5 - Security and protection of personal data


The Personal Data collected are kept in a secure environment. It is hosted by the service provider designated in the Site's Legal Notice.

Zest Publishing takes appropriate physical, technical and organizational measures to ensure the security and confidentiality of Personal Data in order to protect it against loss, accidental destruction, alteration and unauthorized access.

However, Zest Publishing does not control all the risks associated with the Internet. As such, the User consults the Site at his or her own risk, without Zest Publishing being held responsible for any security breach that it is unable to remedy.

ARTICLE 6 - Users' rights

Users have the right to access, rectify and delete their Personal Data.

Since the processing performed within the framework of the operation of the Site is based on the consent of the Users, they may withdraw their consent at any time. They may then no longer be able to benefit from all the services.

If the Users are subscribed to the newsletter of the Site, they can click on the unsubscribe link located at the bottom of each email received.

The User can exercise all his rights electronically by sending his request to emma@bienvenueaucanada.ca, provided he can prove his identity.

ARTICLE 7 - Applicable law and recourse

The present Privacy Policy is governed, interpreted and applied in accordance with Canadian law, and in particular Ontario law.

In the event of a dispute concerning the processing of Personal Data within the framework of the operation of the Site, the User and Zest Publishing undertake to seek an amicable arrangement beforehand and in good faith.

Terms and Conditions of Sale

These terms and conditions of sale are between Zest Publishing, a sole proprietorship registered in the Ontario Business Registry under the number 311049571 and you, the consumer, purchasing products or services from Zest Publishing.


1. Definitions

The website www.bienvenueaucanada.ca is referred to as “the Site.”

The sole proprietorship of Zest Publishing is referred to as “the Company.”

The individual or group coaching service is referred to as “Coaching.”

The consumer who purchases one or more services from Zest Publishing is referred to as “the Customer.”

2. Subject Matter

The following terms and conditions govern the rights and obligations between the Customer and the Company. They apply to all sales of services or digital products presented on the site.

The Company offers individual or group coaching sessions, as well as digital products. The purchase of a coaching service or a digital product from Zest Publishing implies the unreserved acceptance by the Customer of these terms and conditions of sale.

Prior to any transaction, the Customer declares

- That he/she has read the terms and conditions of sale before placing his/her order;

- That his/her purchase is limited to personal and non-professional use;

- That he/she is of full legal capacity;

- That he/she has the appropriate electronic equipment to benefit from the services offered;

- That he/she accepts that the Company reserves the right to modify these conditions of sale at any time and without prior notice.

3. Services offered

The list and description of the services and digital products offered are made available to the Customer on the Site. Zest Publishing reserves the right to modify them at any time.

Zest Publishing offers individual and group coaching sessions. The topic of the session is chosen in advance with the Customer.

Each session lasts 1 hour and takes place on Google Meet platform. A report is given after each session, summarizing the key steps discussed during the session. An invoice is sent to the Customer after each session or at the end of all sessions attended.

The Company Coach systematically warns the Customer that:

- He or she is not a regulated immigration consultant, immigration lawyer, notary public or paralegal.

- He or she is not, and does not claim to be, an immigration agent authorized and paid by the Canadian government.

- He or she will not complete immigration files on behalf of the Customer.

Zest Publishing offers digital products, such as e-books and training courses.

4. Terms of Order

Prior to the purchase of any service, the Customer may outline his or her questions and requirements by

- Filling out a contact form on the website (https://www.bienvenueaucanada.ca/en/coaching)

- Taking a free 20-minute discovery call on Calendly.

Prior to any purchasing, the Company Coach reserves the right to accept or decline a collaboration if it’s outside of his or her area of expertise.

Once both parties have agreed to work together, the Customer can

- Pay for the service;

- Book a coaching session.

5. Fees

The prices of the services offered are indicated in CAD, all taxes included.

Zest Publishing reserves the right to modify its prices at any time, while guaranteeing the application of the price indicated at the time of the order.

6. Terms of payment

The order becomes final and the service is delivered only after the Customer has paid the full price requested by the company.

Payment for services is made online through the Wise payment website. A payment link and instructions will be sent to the Customer.

Zest Publishing is not involved in the financial transactions that take place on the Wise platform. These transactions are the sole responsibility of the Customer and Wise. Wise has its own terms and conditions, which can be found here.

Zest Publishing has no knowledge of, does not record, and does not store the buyer’s payment information when the transaction is completed on Wise. Once payment has been made, Zest Publishing only has access to the following data: email and Customer name, order reference, transaction date and amount.

Zest Publishing reserves the right to refuse access to its services or to suspend its services in the event of a payment incident, risk of fraud, attempted fraud or fraud.

7. Cancellation and right of withdrawal

Once payment has been made, the Customer may cancel at any time before the coaching session is completed. The Customer will then receive a full refund.

However, the right of withdrawal does not apply after the coaching session has been completed. The service will be considered completed and the Customer will not be refunded.

8. Terms of delivery

Booking

Once payment has been made, the Customer can book a time slot for the coaching session(s) on the Calendly platform. They can also click on the “Discovery Call” link on the website (https://www.bienvenueaucanada.ca/en/coaching).

At the time of booking, the Customer can fill out a form indicating the topics and points he/she would like to discuss during the session. The Customer accepts and acknowledges that not all items may be discussed if they are too numerous for the time allotted or exceed the limits set during the initial discussions.

Once the time slot has been booked and the form has been completed, the Customer will receive an email with the login details for accessing the Google Meet session, i.e., a URL link and, if applicable, a password.

Postponement

Any request for rescheduling by the Customer must be made in writing prior to the scheduled date and time of the coaching session.

On the day of the session, and without a prior request for a postponement, the coaching session will be considered completed and will not be subject to a refund or postponement if the Customer does not show up within the first 15 minutes of the appointment time.

Zest Publishing may also change the dates of coaching sessions. In this case, Zest Publishing will notify the Customer in writing as soon as possible. The coaching session will then be rescheduled.

9. Customer Satisfaction

After a service has been provided, the Company may contact the Customer to ask him/her to complete a satisfaction questionnaire. This questionnaire may be used for promotional purposes.

10. Customer Obligations and Limits of Liability

In order to provide the best advice, Zest Publishing requires the full, complete and responsible participation of the Customer. If the Customer’s needs are poorly defined or if the information provided is incomplete, false or misleading, Zest Publishing will not be able to properly perform its services and will not be liable.

Zest Publishing provides its services with due diligence and in accordance with the rules of the trade. It has an obligation of means and not of result, which the Customer expressly acknowledges.

On its website www.bienvenueaucanada.ca, Zest Publishing makes every effort to provide information that is as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or failures to update the site, whether due to its own fault or not. All information provided on the www.bienvenueaucanada.ca website is for informational purposes only.

11. Unforeseeable circumstances

In the event of unforeseeable circumstances, Zest Publishing shall not be liable to the Customer. Unforeseeable circumstances can be

- Earthquakes, fires, storms, floods;

- Legal requirements that limit the freedom of action of one of the parties;

- Blocking of telecommunications (Internet, etc.) and energy supplies (electricity, etc.);

- Interruption of service by one of the Company’s service providers (Calendly, Google Meet, etc.);

12. Personal data

The data collected from the Customer is necessary for the smooth running of the Customer service.

In accordance with the law, Customers have the right to access, rectify, limit or delete their data. Any complaint in this regard must be addressed directly to Zest Publishing in order to find an appropriate solution (emma@bienvenueaucanada.ca).

Details of data processing are given in the Personal Data Charter on the Zest Publishing website.

By ordering a service, the Customer acknowledges having read the Legal Notice and the Personal Data Policy mentioned on the Site.

13. Cancellation in case of fault

In the event of a breach of the General Terms and Conditions (such as providing false information or failing to attend a coaching session), Zest Publishing reserves the right to terminate the contract unilaterally, immediately and without compensation.

14. Disputes and applicable law

In the event of a dispute, the Customer may, in first instance, seek a settlement with a consumer mediator and, in second instance, bring the matter before the court of competent jurisdiction. In Ontario, consumer protection information can be found here.
